1 – Introduction

This Privacy Policy applies to the information practices related to the handling of personal data and respect for the rights of persons concerning the use of the websites: www.perfony.com (referred to as “Perfony’s website” or “the Company’s website”) or to customer extranets such as [xxx].iperfony.com. The texts to which this privacy statement relates are the General Data Protection Regulations (RGPD) and the Data Protection Act. Perfony’s website may contain links to other websites. In no event shall Perfony be liable for the information practices or the content of such other websites. The Company encourages you to review the privacy policies of other websites to understand their information practices.

2 – Security, storage and retention of personal data

Personal and other data are stored in our databases. Perfony uses some of today’s most advanced Internet security technologies. When you access your Perfony extranet, all connections are made using Transport Layer Security (TLS) technology, the most secure standard currently available. Your information is protected through server authentication and data encryption (2048 Bit key). All data is encrypted between your computer and our server. Your data is thus secure and only available to registered users in your company. In order to isolate each Perfony customer’s company, each Perfony extranet is isolated and has its own domain name and database. This prevents any data exchange between different Perfony extranets and increases the level of security. Perfony provides each user in your company with a unique password and user name that they must enter each time they log in. Perfony generates a session “cookie” only to store encrypted authentication information for a limited session duration. The session “cookie” does not include the user’s name or password. Perfony does not use “cookies” to store other confidential session and user information. In addition, Perfony is hosted in a secure server environment that uses a firewall and other advanced technologies to prevent interference or intruders from accessing it. Perfony does not keep personal data beyond the time necessary to complete its processing, while respecting legal and regulatory limits. If you are a Perfony Customer, your data will be kept during the duration of the contract, and for 3 years after its issue, unless otherwise specified by law. If you are a Perfony Prospect, your data will be kept for 3 years from the last contact you had with Perfony, unless otherwise specified by law. If you are a candidate for a position at Perfony, your application data will be kept for 2 years, unless you are hired by Perfony. In the latter case, your personal data will be kept for the duration of the contractual agreement and for 3 years after the end of the latter, unless otherwise specified by law. Finally, cookies are valid for a maximum period of up to 100 days. .

3 – Data Collected

Anyone can visit the Perfony website without having to identify themselves or provide any personal data. On the other hand, when using an extranet dedicated to the customer, when requesting information or creating an account, we may collect all or part of the following data: First and last name, E-mail address Telephone number, Name of the company Mailing address Professional information: (position, function, industry sector) Photos that can be attached to avatars In addition, as part of our constant search for improvement and positioning as an observer of the quality of meetings and action plans, we regularly solicit our users and contacts via surveys.

4 – The use of collected data

The Company uses Perfony’s Customer Data to provide the requested services. For example, if you complete a “Contact” web form, the Company will use the information provided to contact you about your interest in the Services. The Company may also use the Perfony Customer Data for marketing purposes. For example, the Company may use the information you provide to contact you to provide further information on certain topics, including the Services. It will then send you information about the Company and its partners, for example about offers or events. The Company may implement a referral system so that Customers and Visitors can inform friends about the Company’s websites. When using the referral program, the friend’s name and email address will be requested. Perfony will then automatically send a one-time email to the friend in question inviting them to visit the Company’s website. Perfony will not store such information. Perfony publishes a list of Customers and testimonials on the company’s websites with information such as the position and names of Customers. Before publishing testimonials or information on a list, Perfony will ask for the consent of each Customer.

5 – Cookies

Perfony will employ commonly used information collection tools, such as cookies, to collect information when you browse the Company’s websites (“Website Browsing Information”). This section describes the types of information related to your navigation on the website that is collected on the Company’s websites and how this information is used. COOKIES Perfony uses cookies to facilitate your interactions with the Company’s website and to make it relevant. When you visit the Company’s website, Perfony’s servers send a cookie to your computer. By themselves, cookies do not identify you personally. They simply recognise your web browser. Unless you choose to identify yourself to Perfony, by responding to a special offer, opening an account or filling out a web form, you remain anonymous to Perfony. Perfony uses session cookies and persistent cookies. Session cookies only exist for the duration of an online session. They disappear from your computer as soon as you close your browser or turn off your computer. Permanent cookies remain on your computer after you close your browser software or turn off your computer. If you have chosen to identify yourself to Perfony, the Company uses session cookies containing encrypted information to identify you uniquely. Each time you connect to the Services, a cookie per session containing a unique encrypted identifier linked to your account is placed in your browser. These per-session cookies allow the Company to uniquely identify you when you connect to the Services and process your online requests and transactions. Session cookies are a prerequisite for using the Services. Perfony uses persistent cookies that only Perfony can read and use to identify browsers that have already accessed the Company’s websites or the customer’s extranet. When you purchase the Services or provide the Company with personal information, you are assigned a unique identifier. This unique identifier is associated with a persistent cookie that the Company places in your web browser. The Company pays particular attention to the security and confidentiality of information stored in persistent cookies. For example, the Company does not store account numbers or passwords in permanent cookies. By disabling the acceptance of cookies in your web browser, you are still able to explore the Company’s websites. However, if you choose to disable cookies, certain features of our services may not be accessible. Perfony may use session cookie and persistent cookie information in combination with Perfony’s Customer Data to provide you with information about the Company and the Services. IP ADRESSES When you visit the Perfony website, the Company collects your IP addresses (“IP”) to track and gather non-personal information. For example, Perfony uses IP addresses to monitor the regions from which Customers and Visitors browse the Company’s websites. Perfony also collects the IP addresses of Customers when they connect to the Services as part of the security features. THIRD PARTY COOKIES Perfony may occasionally request the services of third-party companies to monitor and analyze the volume and use of statistical information of Visitors to the Company’s Web site. In addition, Perfony may use other third-party cookies to track the Company’s advertising performance. Information provided to third parties does not include personal information. Once received by the Company, however, it is possible to link such information back to personal information.

6 – Sharing personal data

In strict compliance with the principles of Article 2 of this declaration (Security), and unless explicitly stated in this Privacy Policy, Perfony will not share, sell, rent or market under any circumstances information provided by third-party companies for their promotional needs. It’s possible that Perfony occasionally associates itself with other companies to propose a joint offer of products or services. If you purchase a Perfony product or service that is the subject of a joint offer or if you are simply interested, the Company may share with our joint promotion partner(s) the Perfony Customer Data collected in connection with your purchase or expression of interest. In no event will Perfony control our business partners’ use of the Perfony Customer Data we collect. Their use of the information will respect their own privacy policies. If you do not wish your information to be shared in this way, you may choose not to purchase a jointly offered product or service and not to express interest in that product or service. In addition, you can always withdraw your consent to our use and disclosure of your personal data for certain purposes. Perfony reserves the right to use or disclose the information provided if required by law or if the Company reasonably believes that the use or disclosure of such information is necessary to protect its rights and/or to comply with any legal process or court order.

Perfony reserves the right to modify this Privacy Policy. Perfony will notify you of any material changes to this Privacy Policy through the Company’s websites at least thirty (30) business days before they take effect. Perfony has appointed a Data Protection Officer (DPO) whose role is to ensure Perfony’s compliance with the General Data Protection Regulations (RGPD). He/she benefits from the necessary organisational resources and the means to manage his/her duties.
